By accessing or using Showly ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
Showly is a real estate showing scheduling platform that enables real estate agents to create shareable booking links for property showings and allows potential buyers to schedule viewing appointments.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities that occur under your account
4. Subscription and Payment
Free Trial: New users receive a 14-day free trial or 3 showings, whichever comes first. No credit card is required for the trial.
Subscription Plans:
- Founder Plan: $29/month (limited to first 200 customers, pricing locked forever)
- Pro Plan: $39/month
Subscriptions are billed monthly. Payment is processed through Stripe. You can cancel your subscription at any time.
5. Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:
- You will retain access until the end of your current billing period
- Your subscription will not renew
- No refunds are provided for partial months
- You may cancel during your free trial with no charges
6. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose
- Violate any laws or regulations
- Infringe on the rights of others
- Transmit spam, viruses, or malicious code
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Scrape, copy, or reverse engineer the Service
- Impersonate another person or entity
- Share your account credentials with others
7. Content and Intellectual Property
Your Content: You retain all rights to the content you post on the Service (property listings, photos, descriptions). By posting content, you grant us a license to use, display, and distribute it as necessary to provide the Service.
Our Content: The Service, including its design, features, and functionality, is owned by Showly and protected by copyright, trademark, and other intellectual property laws.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOWLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
10. Indemnification
You agree to indemnify and hold harmless Showly from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
11. Termination
We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
